Our complaints procedure

This guidance note provides you with more information about our firm’s complaints procedure. This guidance applies only to our clients. If you are not a client and wish to complain about something, please contact us on 0203 830 3831.

At Elaahi & Co Solicitors, we are committed to providing high quality legal advice and client care to our clients. However, if at any point you become unhappy or concerned about the service we are providing, please inform us immediately so that we can do our best to resolve the problem.

In the first instance it may be helpful to contact the person who is handling your matter. If you still have queries or concerns, please contact Anosha Saleem who is our head of practice to whom any final issues can be reported.

Formal complaint procedure

The following outlines our recommended procedure for making a formal complaint. Please note that making a complaint will never affect how we handle your case.

  1. A formal complaint should be addressed to our head of practice Anosha Saleem in writing at 210 Coppergate House 10 White's Row, Spitalfields, London, E1 7NF. Please set out the details of the complaint as fully as possible.
  2. We will acknowledge your complaint within 7 working days of receipt and will advise you of the steps to be taken to resolve your complaint.
  3. Our head of practice will show your complaint to the person responsible for your matter and ask them to conduct a complete review of the file and to respond in writing. They will also interview any members of staff involved in your matter.
  4. You will receive a written response to your complaint within 30 days from the date the complaint is first received. This response will set out the result of our investigation, any proposed resolution and, if relevant, any procedural changes we will make to ensure the situation does not arise again. If the head of practice is unable to reach a decision within that time frame, she will inform you accordingly.

Taking the complaint further

We are regulated by the Solicitors Regulation Authority and complaints and redress mechanisms are provided through them and the Legal Ombudsman.

We have a total of 8 weeks, from the date of receipt, to consider your complaint. If we have not resolved it within this time, you can complain to the Legal Ombudsman. If you are not satisfied with our handling of your complaint you can ask the Legal Ombudsman to consider the complaint. They will consider your complaint independently and it will not affect how we handle your case.

Before accepting a complaint for investigation, the Legal Ombudsman will check that you have tried to resolve your complaint with us first. If you have, then you must take your complaint to the Legal Ombudsman within:

(a) six months of receiving a final written response from us about your complaint and

(b) no more than one year from the date of the act or omission about which you are complaining; or

(c) no more than one year from the date when you should reasonably have been aware that there was cause for complaint.

The contact details of the Legal Ombudsman are as follows: Legal Ombudsman, PO Box 6167, Slough, SL1 0EH. You can call them on 0300 555 0333 between 9am to 5pm or email them at enquiries@legalombudsman.org.uk. Their website address is www.legalombudsman.org.uk

The Solicitors Regulation Authority can assist if you are concerned about our behaviour and you can raise concerns at the www.sra.org.uk/consumers/problems/reportsolicitor. page website address. Complaints about a client’s rights under the General Data Protection Regulations must be submitted to the Information Commissioner’s Office – www.ico.org.uk

Any disputes or legal issue arising from our Client Care and Terms of Business will be determined by the law of England & Wales and considered exclusively by the English & Welsh courts.

We will provide you with a copy of our complaints procedure at anytime upon a request.
